Purpose of this Privacy Policy

This Privacy Policy aims to give you information on how Yoobee Colleges Limited, trading as Cut Above Academy (Cut Above), an Up Education Limited company, use your personal data.

This policy applies to any personal data collected through your use of our website, including any data you may provide to us via the Cut Above website or official social media channels, or any other interaction that you have with us. Cut Above deals with personal information in line with the Privacy Act 2020.

It is important that you read this Privacy Policy together with any other privacy notice on our website from time to time so that you are fully aware of how and why we are using your data. By voluntarily providing us with your personal data, registering for one of our events, using our website, or engaging with us in any other way, you acknowledge the terms of this Privacy Policy.

Collection of Personal Data

Cut Above collects personal information, including sensitive information, about:

  • students and parents and/or guardians;

  • potential students;

  • former students, graduates, and alumni;

  • potential employers and industry partners; and

  • agents, school professionals and other people who come in contact with Cut Above.

The personal information we collect includes identity, contact, profile, financial, transaction, technical, usage, and marketing and communications information.

We do not knowingly collect any information from children under the age of 16 unless we have the relevant consent and authorisation.

How Is Your Personal Data Collected?

We use different methods to collect data from and about you including through:

  • Direct interactions. You may give us your: identity data, contact data, transaction data, financial data and marketing and communications data by filling in forms on our website or in person at one of our campuses, or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you apply for one of our products or services and when you maintain an ongoing relationship with us as a student.

  • Automated technologies or interactions. As you interact with our website, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies. We may also receive Technical Data about you if you visit other websites employing our cookies.

  • Third parties: In some circumstances, Cut Above may be provided with personal information about you from a third party. For example Google Analytics.

How We Use Your Personal Data

We will use your personal data for the purposes outlined in this Privacy Policy, including our core activity of managing and operating Cut Above, and where we need to do so in order to comply with a legal or regulatory obligation.

Cut Above may not be able to enrol or continue the enrolment of a student if necessary information about the student or parent/guardian is not provided.

Purposes For Which We Will Use Your Personal Data

We have set out below the ways in which we may use your personal data.

  • To register you as a new student;

  • To manage our relationship with students, including keeping students informed about matters related to them through correspondence, newsletters and magazines;

  • To ensure the educational, social, and medical wellbeing of students;

  • To arrange and manage a student industry placement;

  • To administer our business, including: managing payments, fees and charges, managing your queries – this may include recording calls or communications with our teams, business planning and operations, and satisfying our various legal obligations (including the preservation of academic records) and allowing Cut Above to discharge its duty of care;

  • To collect and recover money owed to us in respect of your contract;

  • To carry out fraud assessments;

  • To notify you in relation to our legal obligations and documents, including changes to our terms or Privacy Policy;

  • To help us improve our offering to our students, including asking you to leave a review or take a survey, or provide insights;

  • To enable you to partake in one of our awards or a competition;

  • To administer and protect our business and websites (including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data);

  • To deliver relevant website content, advertisements and other marketing material to you and measure or understand the effectiveness of the advertising we serve to you;

  • To use data analytics to improve our website, products/services, marketing, customer relationships and experiences;

  • To make suggestions and recommendations to you about products or services that may be of interest to you.

We may aggregate and/or anonymise personal data so that it will no longer be considered personal data.

Marketing

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.

We may use your identity, contact, technical, usage and profile data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing).

You will receive marketing communications from Cut Above if you have requested information from us or purchased products (including publications) or services from us or if you provided us with your details when you entered a competition or registered for a promotion and, in each case, you have not opted out of receiving that marketing.

We may also share marketing communications relating to other Up Education Limited colleges, where we have your consent to do so.

Opting Out

You can ask us to stop sending you marketing messages at any time by following the opt-out/unsubscribe links on any marketing message sent to you or by contacting us at any time.

Cookies

A cookie is a small file that is placed on your computer’s hard drive when a website is visited. The permission to load a cookie is controlled by the settings of your browser. When the file is added, it stores a counter and a simple tag, which is used to track the pages that are visited and how many times you have returned. This helps us analyse data about web page traffic and improve our website and then tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system. It should be noted that there is no private information about you stored in a cookie, such as name or contact details. Further, a cookie in no way gives us access to your computer. You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can modify your browser setting to decline cookies if you prefer. If you disable or refuse cookies, please note that some parts of our website may become inaccessible or not function properly.

Disclosures of Your Personal Data

We may share your personal data with the parties set out below for the purposes set out above:

  • UP Education Limited.

  • Other companies in the UP Education Limited group for the purposes of marketing, where we have your consent to do so.

  • External Third Parties, if related to the purposes for which the personal data is collected, these can include providers of services such as website hosting, data analysis, information technology, auditing, payment processing, and other services.

  • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Privacy Policy.

  • To comply with an applicable law, to cooperate with law enforcement, to respond to requests from public government authorities, and other legal reasons for disclosure.

We note that we also seek your consent to share your personal information, in specified circumstances, in the Cut Above Application Form.

We will only send personal information outside New Zealand in compliance with the Privacy Act 2020.

Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Data Retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any compliance, legal, accounting, or reporting requirements. When no longer needed, we will securely dispose of your personal information in line with our Retention Policy.

Your Legal Rights

You have the right to:

  • Request access to your personal data.

  • Request correction of the personal data that we hold about you, though we may need to verify the accuracy of the new data you provide to us.

  • Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

In some instances, you may also have the following rights:

  • Request erasure of your personal data. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

  • Object to processing of your personal data.

  • Request restriction of processing of your personal data.

  • Request the transfer of your personal data to you or to a third party.
